On painting Summary and Analysis The selection from Leon Battista Alberti’s On painting is mainly divided into 5 paragraphs numbered 25 through 29. Just as the title suggests, the text deals with the art of painting and its virtues. It talks about the benefits painting offers to the artist and why they are valuable, as well as showing the importance a work of art gives to the object being painted. While referring to many examples in history, Alberti also compares painting to the other â€Å"crafts† and explains why it is more noble, as well as more enjoyable and self-satisfactory. It is therefore clear that the author believes painting to be somewhat in metaphysical nature, something beyond the ordinary. Throughout history, specifically in ancient Rome and Greece, people admired painting to the point where it was taught to every son of respectable families, yet forbidden to the slaves. This goes to show how this form of art in particular was considered fit only to those of high social class. Although it was reserved for the educated and cultured, painting attracted everyone and pleased them equally. In particular, â€Å"[n]ature herself delights in painting.†(Alberti 64) Alberti persists in showing us how painting is of nature; he first references nature by saying that Narcissus was the inventor of painting. In the myth of Narcissus, nature plays the role of the artist who paints a portrait so beautiful that Narcissus cannot take his eyes off of it. To further convince the reader of th e pleasures painting gives, the author recounts a personal anecdote of how gratifying and relaxing painting can be. Organizations cannot expect for diversity and inclusion to appear and work smoothly within the workplace automatically. Diversity and inclusion is a journey that companies must take to reap the rewards of being a truly global business. There are eight steps that organizations can apply to their workplace that will make diversity and inclusion a smooth and fun journey. Paternalism In Mental Health Treatmen Essayt The assignment for this Ethics class was to review Mr. Jacobs treatment, as described by the New York State Commission on Quality of Care for the Mentally disabled (1994). The class was further asked to comment on the major issues for each of the three perspectives. The agencies, family and review board were to be included. This student will begin with a fourth perspective; that of Mr. Gordon. In the Matter of Jacob Gordon (1994), is the story of the last eight years of a psychiatrically disabled mans life. Mr. Gordon appeared to vacillate between striving for autonomy and accepting the support of his family. Unfortunately, it appeared by this account that the families support was not synonymous with autonomy. It did not appear that Mr. Gordon had ever desired or sought agency intervention for himself. Mr. Gordons association with the mental health system appeared to be marked by power and control issues. Consumers/ex-patients often report a feeling of invisibility; they sense that their views and desires do not matter (Carling, 1995, p.79 ). The commissions report (1995) spoke of several incidences where Mr. Gordon eluded to his desire for autonomy. Mr. Gordon did not wish to live in a supervised setting. Mr. Gordon did not wish to attend group day treatment settings. Mr. Gordon did not wish to use medication in the treatment of his mental health disorder. Without medication his behavior was deemed unacceptable and did not permit him the opportunity to have any of these choices. Choice is a right-not a privilege to be afforded by good behavior (Penny, 1994, p. 29). Mr. Gordons right of choice was limited even though he lived in his apartment independently. The condition of his apartment was scrutinized. His medication was closely monitored; sometimes to the degree that he was directed to leave his home to receive medication that was given to him crushed, in an attempt to insure its ingestion. Even peoples liberties in a highly controlled board and care home may be scarcely greater than in a hospital ward (Rubenstien, 1994, p.54). In Mr. Gordons case even within the sanctity of his own home, his liberties were scarcely greater than in a hospital ward. Other than his autonomy the second issue for Mr. Gordon appears to be the need for safety and support. For this, Mr. Gordon turned to his family. The report (1994) points out that Mr. Gordon requested his mother be limited in her ability to access personal information. He continued to need her support and assistance although this met she continued to be overly involved in his life. It was his mother he turned to when he had problems with a roommate. It was his mother who was utilized when Mr. Gordon was less compliant. It was Mr. Gordons family who assured that he had continued mental health counseling and services. It was also Mr. Gordons family who appeared to be the focal point of any plans for Mr. Gordon. .. .expectations, soon to be dashed by programs more devoted to servicing neurotic families than people with schizophrenia (Rubenstien, 1994, p.55). Mr. Gordon remained safe and close to his family by relinquishing his autonomy. Mr. Gordons safety was the most important issue for the family. Secondarily to his safety, Mr. Gordons family wished him to have the opportunity to participate in programming that would assist in his wellness. For Mr. Gordons family, wellness seemed to equate to a standard of behavior that his mother personally viewed as normal. The family were not bound to any code of ethics or compelled to understand their biases or prejudices in their sons case. Certainly, to say that the family operated on the premise of paternalism is an understatement. Ethically, the Gordons believed that they were the most justified to speak in the best interests of their son. The energy that the Gordons put into advocating for what they believed, was in their sons best interest, is a testimony to the depth of the feelings they had for their son. Looking at the commissions report and attached responses from agencies (1995), it appears as though all of the agencies and practitioners involved were overly respectful of the involvement of Mr. Gordons family. The Conclusion of Guilt Essay The many different works of Edgar Allan Poe all aim to do one thing. Strike fear into the heart of the reader. Simple, yet effective, he expresses fear through these many different themes and motifs. In many of Poes works he describes the evil drive in men to kill and commit sin. He likes to focus on the downward spiral of the human race instead of romanticising them. The guilt of the narrator is a major theme in ‘‘The Tell-Tale Heart. ’’ The major symbol is the beating heart. Poe chooses a heartbeat because it is human and maddengly persistant.The thematic subject may be guilt, but the theme is that the human heart cannot endure the burden of guilt, especially in the case of murder. The guilty must confess somehow or be consumed by his or her conscience. Our narrator has this strange capacity throughout the text to hear a heartbeat. This seems to haunt him, but a greater label for the repeated disturbance would be guilt. Having killed someone close to him, he tells on himself but it is hard to identify what occurs as remorse, a feeling we would expect for such a crime so we have to turn to insanity.Poes short stories often have a single, unifited theme that reaches the reader through diction, characterization, plot, dialogue and other elements. The theme of this story might be guilt. The corpse invariably symbolizes some flawed portion of the narrators personality in this case, his inability to see the world with a clear eye and the house represents the narrator himself. Burying the corpse within the house represents the narrators attempt to bury his flaws rather than dealing with them. and thinks he has freedom from guilt, the feeling of guilt over the murder is too overwhelming to bear.The narrator cannot tolerate it and eventually confesses his supposed perfect; crime. The emotion of guilt easily, if not eventually, crashes through the seemingly unbreakable walls of insanity. I believe that the theme of â€Å"The Tell-Tale Heart † is that all human beings are more than capable of committing senseless crimes, but the guilt will always linger and serve as punishment. This shows how guilt also torments humans after they commit any kind of crime or senseless deed. The readers can also see how the guilt torments the narrator through his inner thoughts.The narrator describes how he is feeling when he hears the heartbeat and suspects that the police must hear it too. â€Å"I felt that I must scream or die! — and now –again – hark! louder! louder! louder! LOUDER! — † (Poe n. pag). If this story had been written in another point of view, it would have most definitely not been effective in conveying the theme of guilt. The reader needs to be aware of the thoughts and feelings of the narrator in order to understand how he is hearing the heartbeat of the man in his head.

This is where many people lack skill. With an education, the person is able to manage money and save his/her earnings. Some very rich people have little education yet continue to succeed in life yet these are unique people. Not everyone is able to succeed like those people, most need education to guide and strengthen his/her natural abilities. Education provides a way for intelligent people to ascend above his/her peers and be successful. Education guides people toward success by accenting their traits of triumph. My definition of the word success: being able to adequately provide for your family, to be sophisticated, to have wealth, to be happy with what you are doing, to be proficient at your career, to be respected, and to be able to reach your lifelong goals. The Webster’s Dictionary defines it as: â€Å"1. The achievement of something desired, planned, or attempted: attributed their success in business to hard work. 2. a. The gaining of fame or prosperity: an artist spoiled by success. b. The extent of such gain. 3. One that is successful† I am a high school graduate and I now attend college. I will use the following examples of quality, employment, health care and society, to show why Communism is a better form of economic organization. Meaning the governments owns all the factories and stores because their is no private owner ship in a Communist system. Another reason why Communism is good is because everyone in the country is provided with a job, house and food; no one is denied the essentials of life. One of the most fundamental human rights is access to adequate health care. In Communist countries the right of access to health care is very well practiced, because no one is denied health care. ”Oliver Twist” by Charles Dickens and ”Brick Lane” by Monica Ali Essay

Having read both Oliver Twist by Charles Dickens and Brick Lane by Monica Ali, I am going to concentrate the city question on Brick Lane. Brick Lane tells the story of Nazneen, an eighteen year old moved to London from her rural upbringing in Bangladesh to Tower Hamlets, a close tight community of Bengali families living in blocks of flats struggling to make their way up in the city to earn sufficient money and a civilised upbringing for their children, yet still yearning to go back to their home land. Nazneen is married to Chanu, twenty years older than her, he is educated yet earns his money working as a taxi driver. This novel has clear descriptions of city life, the diversity of the people within and how Nazneen interprets the city from her point of view. There are many ways in which the material conditions of the city are described in this novel, the different areas of the city of London are described from the block of flats where Nazneen lives to the big office blocks in the city centre. City life in this novel begins with Nazneen describing the ‘Tattoo lady’ who lives in the block of flats opposite her, from here we become familiar with the lack of space and understand the very little room they have in the urban areas of London â€Å"Most of the flats that closed three sides of a square had net curtains and the life behind them was all shapes and shadows. But the tattoo lady had no curtains at all. Morning and afternoon she sat with her thighs spilling over the sides of her chair†¦.† By reading this, it is already forming an idea of the main settings of the novel which are the block of flats, very cramped and close, very little sense of privacy. We also get an idea of the type of people living around the area as well, the tattoo lady is frequently mentioned in the novel, informing us that â€Å"at least two thirds of the flesh on show was covered in ink.† Another material condition of the city we come across in this novel is when Nazneen actually considers visiting the tattoo lady at the flat opposite hers, however such is city life that Nazneen reconsiders this â€Å"The tattoo lady might be angry at an unwanted interruption.† Although this is not an actual object described in the city, from Nazneen’s thought we get an idea of the type of people she would come across whilst living in the city, it forms the surroundings of the narrative by mentioning Nazneen’s neighbours. Monica Ali also describes the smell of the surroundings where Nazneen lives â€Å"The breeze on Nazneen’s face was thick with the smell from the overflowing communal bins.† This material condition most definitely helps to form the surroundings of the novel shaping the condition of the area where Nazneen lives. Although Monica Ali has focused on forming the surroundings of the city where Nazneen lives with the smell and the neighbours, she has also formed the novel with the material conditions of inside the flat where Nazneen lives, in the novel Nazneen spends most of her time inside the flat â€Å"to sit day after day inside this large box with the furniture to dust, and the muffled sound of private lives sealed away above, below and around her.† By giving brief descriptions like this it shapes the scene of the narrative from the beginning of the novel, we are informed of the furniture inside the flat, Nazneen mentions that she has never seen more furniture inside one room, with all this, we are already shaping the narrative with the material conditions inside of Nazneen’s flat. Whilst living in the city, Nazneen mentions outdoor surroundings quite often, although she spends most of her time inside her flat or at Razia’s, whenever Nazneen has gone outside the boundaries of her area, we as the are given more description of the actual city conditions â€Å"There were more cars than people out here; a roaring metal army tearing up the town.† By describing the cars as an army tearing up the town, we can immediately shape the city life of the narrative with the pollution and the noise of the cars. We can imagine the dirt and the hustle of the city. â€Å"The people who passed walked, looked ahead at nothing or looked down at the pavement to negotiate puddles, litter and excrement.† This was the material conditions of the city life which helped form the narrative, which helped give the reader an idea of the city life and scenes to which we can imagine Nazneen and her husband walking across. The social life in this novel also helps to form the material conditions of city life and the novel, Nazneen’s social life throughout the novel consisted of Mrs Islam and Razia gossiping about fellow women, she would often visit Razia at her flat, whilst going to Razia’s flat we are given descriptions of the surroundings within Nazneen’s boundary of her estate, we are informed of the â€Å"group of young Bengali men who stood in the bottom of the stairwell, combing their hair and smoking or making loud, sudden hoots†¦Ã¢â‚¬  this was the social life the young men had in the city, they would hang around in gangs not achieving much, Nazneen stayed within her boundaries as well, so it gives the reader an impression that social life within a city should be kept in the boundaries that you live in, like a safety barrier. We are also informed of the material conditions of the corridors and stairwells where Nazneen lives, the front doors are mentioned to be the sam e across the corridors â€Å"peeling red paint showing splinters of pale wood, a rectangular panel of glass with wire meshing suspended inside, gold rimmed keyholes and stern black knockers.† On the wall â€Å"someone had drawn a pair of buttocks in thick black pen†¦Ã¢â‚¬  this helps the reader to form a picture in their minds of the state of city life where Nazneen lives, â€Å"The stairs gave off a tang of urine† Although Nazneen is told to stay within the boundaries of the estate because if she went out people would talk and gossip about her, Nazneen did go out. This was when she got lost, and we as the readers gained more knowledge of the material conditions of city life which formed the narrative, we are told that â€Å"to get to the other side of the street without being hit by a car was like walking out in the monsoon and hoping to dodge the raindrops.† Immediately we can imagine the fast movement of the city, cars going past like buzzing bees, to cross the road, Nazneen â€Å"waited next to a woman and stepped out with her, like a calf with its mother† short descriptions like this form the material conditions of the city life in this novel so skilfully. Throughout the novel, we are not only informed of the material conditions of the city where Nazneen lives or around the area of Bethnal Green, we are also informed of the streets buildings past Brick Lane. â€Å"She looked up at a building as she passed. It was constructed almost entirely of glass, with a few thin rivets of steel holding it together.† â€Å"The building was without end, above somewhere it crushed the clouds.† The material conditions mentioned here are most entirely opposite to the towers described of Tower Hamlets. Although both scenes have very large buildings, the towers in the city centre are described as â€Å"palaces†, with â€Å"entrances and colonnades across the front† this was the diversity of the material conditions of city life which helped form the narrative, because the reader is informed that the city is not the same throughout, every area has its own distinctive features, some parts of the city are very well looked after whe reas others such as where Nazneen lives are forgotten about. The material conditions of city life in the novel are mentioned to the reader in many ways, we are told of the people that Nazneen walks past when she goes to the city centre â€Å"every back she saw, was on a private, urgent mission to execute a precise and demanding plan†¦.† â€Å"They could not see her anymore than she could see God† from this, we acknowledge the independency of the people in the city. Soon Nazneen realises that she does not fit in with these working people, they are dressed smart, they have coats and handbags whereas Nazneen has a cardigan and a sari, although Nazneen was dressed differently, only one woman noticed she was there and smiled at her. By giving details such as this, Monica Ali has formed and shaped the narrative according to city life, every person with its own mission. So far, throughout the novel, only roads and streets, people and buildings have been mentioned. However when Nazneen does come across some greenery, she says â€Å"in this city, a bit of grass was something to be guarded, fenced about, as if there were a sprinkling of emeralds sown in among the blades.† This, yet again is another material condition of city life, although it is not unpleasant like the conditions in Nazneen’s area, green grass has not yet been mentioned up until now, and when it has the grass is guarded with fence, so from this, we can imagine the very few places in the city to relax and enjoy the scenery. We also get the indication that in this novel, for Nazneen there is no place for her to get away from everything, the city â€Å"would not pause even to shrug.† Throughout the novel, the descriptions of the city and the buildings given to us by Nazneen have been described just as Nazneen saw them, however, later on in the novel, when Nazneen’s son becomes ill, whilst in the ambulance van, and with her fear for her son, she mentions â€Å"The city shattered. Everything was in pieces. She knew it straight away, glimpsed it from the painful white insides of the ambulance.† Just as Nazneen’s heart shattered in pieces, the city did too with her, so she is relating the material conditions of the city with her emotions and giving the reader an image of doom and gloom within the city. Although the material conditions described to us previously in the novel have been mostly doom and gloom anyway, Nazneen has only just implied the greyness and dullness of it along with her emotions. â€Å"Frantic neon signs. Headlights chasing the dark. An office block, cracked with light. These shards of the broken city.† Up until now the city was not mentioned as broken, it was just described as how Nazneen saw it, but now, we get the real image of the city, the material conditions which helped form the narrative † The crystal towers and red bricked tombs. The bare-legged girls shivering at the bus stop.† Up until now, Nazneen had simply described the different dress code of non Asian females, now that she saw they were at the bus stop bare legged in the early hours of the morning, Nazneen is ridiculed by them, she talks about them along with the broken city. She is giving the reader material conditions of the city which make it so grim. â€Å"The well fed dogs and bloated pigeons.† This is something Nazneen would never see in her homeland Bangladesh, dogs are of no importance and pigeons always a pest. So now, we get to witness Nazneen’s interpretations of the material conditions of the city life, how she feels it is all wrong compared to her land. â€Å"The cars that had screamed alongside the ambulance, urging it on, parting in waves.† The cars that had previously been described as an army now screaming, this clearly shows the rage within Nazneen and the material city conditions which she so hates. Throughout the novel, London is not the only city mentioned, with Nazneen’s sister living in the city in Bangladesh, Dhaka, she often receives letters from Hasina talking about her home, and the surroundings â€Å"Street is wide and nice. But plastic bag blowing everywhere. Walk in street for five ten minute and by finish you cover in bag on legs and arm and stomach.† From this we realise, that city conditions throughout the world are the same. The little things which give the city its status, the material conditions such as bags on the floor is what makes living in a city so different to other places. â€Å"A wind blew in over the courtyard and fetched up a crisp packet at her feet.† Nazneen although she was in a different country to her sister, they were both in the same situation, both living in a city with material conditions such as rubbish on the pavements and non stopping people. To conclude, the material conditions of city life in Brick Lane are mentioned with such metaphors and descriptions which inform the narrative of the surroundings, the people, the scenery and the atmosphere within. The buildings described in so many ways, the smallest details found on the floors to the stairwells of the block of flats.

Just because someone holds a position of power doesnt indicate that the person is morally superior. The play questions whether it is possible to legislate issues of morality and how to do so. Had Claudio been executed, he would have left Juliet with a child and a tattered reputation. She would have no way to look after the child. Angelo was clearly in the wrong morally, but he was given a job to do and followed through. He wasn’t going to legislate against himself. The Duke has fallen in love with Isabella, Claudios sister, so  his decisions regarding punishment for Claudio and Angelo may have been skewed. The play suggests that people should be answerable for their sins but should receive the same treatment as they provided. Treat others as you would like to be treated, and if you commit a sin, expect to pay for it. Sex Sex is the main driver of the action in this play. In Vienna, illicit sex and prostitution are major social problems, resulting in illegitimacy and disease. This too is a concern for Shakespeare’s London, especially with the plague, as sex could result in death. Mistress Overdone represents the casual access to sex in the play. Claudio is sentenced to death by beheading for impregnating  his fiancà ©e. Isabella is told she can save her brother by having sex with Angelo, but she risks spiritual death and the death of her reputation. The play questions whether it is right for government to legislate against sexuality. Marriage Shakespeare’s comedies often are celebrated by a marriage, which is usually seen as a happy ending. In Measure for Measure, however, marriage is used as a punishment, Angelo is forced to marry Mariana and Lucio is forced to marry Mistress Overdone. This cynical look at marriage is unusual in a comedy. Ironically, marriage here is used to regulate and punish promiscuous behavior. Marriage saves the females reputation and gives them a position they would not have had. For Juliet, Mariana, and Mistress Overdone to an extent, this is the best option. Readers are asked to consider whether marriage would be a good option for Isabella, because she could marry the Duke and have a good social position, but does she love him or is she expected to marry him out of appreciation for what he has done for her? Religion The title of Measure for Measure comes from the gospel of Matthew. The plot includes a  passage where a hypocritical deputy sentences a man to death for fornication and then propositions a  woman. The main themes are associated with religion: morality, virtue, sin, punishment, death, and atonement. Its main character, Isabella, is obsessed with virtue, chastity, and her spiritual journey. The Duke spends most of his time dressed as a friar and Angelo has the attitude and demeanor of a puritan. The Role of the Female Each woman in the play is controlled by the forces of patriarchy. They are vastly different characters, but their social standing is limited by the men in their lives. Slavery Without Submission Essay In chapter 9 of Howard Zinn’s A People’s History of The United States, Zinn analyzes, in details about the tough and troublesome living arrangements the slaves had to endure during the early 1800’s, the slave revolts that were started because of these living conditions, and how Abraham Lincoln was elected President, which led to the Civil War because the Southern States thought Lincoln was siding with the northern states about the slavery issue. In this Chapter, Howard Zinn is comparing what happens with the smaller slave rebellions that happened earlier on to what Abraham Lincoln eventually did, except Lincoln having done it on a much, much larger scale. The slave system was such an in depth system that made an abundance of money for the country. Southern states relied heavily on cotton, which was picked by the slaves. Since the southern states did depend on slave labor so much, Abraham Lincoln knew that these would be key reasons as to why abolishing slavery would be incredibly hard. Zinn talks about how the majority of slaves would either run away from their masters or physically revolt against their masters. Eventually, slave masters started to worry about slave revolts since they had started to become more popular in America. Zinn wrote†¦ â€Å"Religion was used for control. A book consulted by many planters was the Cotton Plantation Record and Account Book, which gave these instructions to overseers: You will find that an hour devoted every Sabbath morning to their moral and religious instruction would prove a great aid to you in bringing about a better state of things amongst the Negroes. I agree with this sentiment wholeheartedly. In my opinion, The Bible’s words have been twisted ever since it has been written and in the article â€Å"How The Bible Was Used To Justify Slavery†, it talks about how slave owners would have essentially used fear in the words of scripture on the slaves to scare them into not revolting against their masters (Blake). The main reason that these revolts never developed into anything serious is because the national government would not allow it. Even the more educated African Americans tried to rebel against the practice of slavery but in more civil terms. David Walker, a free and educated African American wrote a pamphlet called Walker’s Appeal. This pamphlet was not one of the more civil anti-slavery documents of this time. The pamphlet focused on a kill or be killed attitude if slaves wanted to obtain their freedom from their masters. This pamphlet did not go over well with southern slave holders. The state of Georgia offered money for the death of David Walker, who was later found to be dead. This was another form of fear that was used against slaves and another example of the national government, not allowing a revolution to take place. The national government’s stance was that slavery was not going to end, unless they agreed to it. Even Abraham Lincoln was not for the equality of African Americans, at least at first. Lincoln is quoted as saying â€Å"I will say then that I am not, nor ever have been in favor of bringing about in any way the social and political equality of the white and black races – that I am not nor ever have been in favor of making voters or jurors of negroes, nor of qualifying them to hold office, nor to intermarry with white people, and I will say in addition to this that there is a physical difference between the white and black races which I believe will forever forbid the two races living together on terms of social and political equality. And inasmuch as they cannot so live, while they do remain together there must be the position of superior and inferior, and I as much as any other man am in favor of having the superior position assigned to the white race. I say upon this occasion I do not perceive that because the white man is to have the superior position the negro should be denied everything. † (Lincoln, 145-146). Lincoln was for the progress of the country, first and foremost. Lincoln knew that slavery was a subject that could divide the nation and that slave labor was making the country money, so he could not just outright abolish it or let these revolutions of the slaves succeed. Zinn reiterates this fact when saying†¦Ã¢â‚¬Å"He opposed slavery, but could not see blacks as equals, so a constant theme in his approach was to free the slaves and to send them back to Africa† Lincoln was somewhat of a flip-flopper when it came to whom he was talking to about the subject to. It was not until the Civil War started and the casualties were getting higher and higher that Lincoln decided to enact the Emancipation Proclamation. The Emancipation Proclamation obviously did not go over well with southerners, but Lincoln did it to preserve a win for the Union, but it also did not go over well with anti-slavery forces, because for good reason, they believed that everyone should have the right to be free. This led to the passing of the Thirteenth Amendment, which officially abolished slavery. With all of this happening, resentment towards African Americans continued to grow and this time in the northern states. Poor northerners started looking at the war as liberation of African Americans that they had been dying for, so they started a riot against many African Americans. After all of this had happened, Lincoln was eventually assassinated, and Andrew Johnson became president and somewhat hurt the progress of African Americans. The government tried to give more rights and privileges to African Americans, but had a hard time keeping the situation under control. Black codes were started up, as well as the Ku Klux Klan. The government wanted to keep the white elites happy, but this in turn would usually mean something not appealing for African Americans, which would make it into a vicious circle. Howard Zinn’s point of this whole chapter was that for anything to actually change, something monumental would have to happen, not a revolt, not slaves running away, but a full fledged war. Even with this actually happening, with the Civil War, it was not fully accepted till years later. The slave system was in place such an in depth labor system that made so much money that people could not fathom a world without slaves, even though most knew it was morally wrong.

From Poverty to Powerhouse: Michael Oher’s Story Michael Oher was from an all-black neighborhood located in the third poorest zip code in the country. By the time he was a sophomore, he’d been to 11 different schools, he couldn’t read or write, and he had a GPA of 0.6. In his first-grade year alone, he missed 41 days of school and ended up repeating both the first and the second grade; he didn’t even go to the third grade. Oher was one of the thousands of children that have been identified as having four or more of the at-risk factors mentioned by the National Center of Education and Statistics (NCES). According to the NCES, poverty and race are high on the list of things that negatively affect students’ ability to succeed at school. Other risk factors include changing schools multiple times and being held back from one or more grades. Oher’s biography, The Blind Side by Michael Lewis, proves how socioeconomic status impacts a child’s academic success because placed in perspective, educati on is not as important as the hardships of reality. Before explaining how The Blind Side depicted the effects of socioeconomic status on Michael Oher’s education, it is important to make clear what it means to â€Å"prove.† According to Oxford Dictionaries, â€Å"prove† means â€Å"to demonstrate one’s abilities or courage† (â€Å"Prove† 1.5). The Merriam Webster Dictionary gave other definitions including â€Å"to show that (someone or something) has a particular quality or ability (â€Å"Prove† 1); â€Å"to test the worth or quality of, specifically: to compare against a standard† (â€Å"Prove† 2b), and â€Å"to show oneself to be worthy or capable of† (â€Å"Prove† 4). All of the above definitions of â€Å"prove† have a form of the words â€Å"quality† or â€Å"ability† in them. An example of this is when... ...nomic status. In 2012, 26.5 million (13.7 percent) of people ages 18-64 were in poverty. Also in 2012, 16.1 million (21.8 percent) children under the age of 18 were in poverty. The hardships this creates causes education to suffer. It has to take a backseat to finding food or a place to sleep. These children’s families are at-risk for dropping out of school compared to higher socioeconomic students. That number is going to continue to grow with the current rate of population growth. In contrast, children from higher socioeconomic families do better in school. When the Tuohy’s brought Michael into their life, his opportunities for education improved. What happened to Michael Oher was unique because of his special abilities, his courage, and the help from the Toughy’s. Michael’s story shows how socioeconomics can impact students’ academic success. It identifies the categories, forms, parties and highlights of the arbitration agreement. It also examines the enforcement of an arbitration agreement. This paper reveals that arbitration is a major attraction as being the most flexible way of settling dispute. Thus, it was suggested that arbitration agreement is a vital component of an arbitration proceedings. 1. 0INTRODUCTIONArbitration has continued to maintain the lead as the preferred mechanism for resolution of domestic and international business disputes in the Nigerian legal system. An arbitration agreement means a voluntary agreement to submit to arbitration present or future disputes, â€Å"whether contractual or not†. It is clear; therefore, that a claim in tort or fraud may be the subject matter of an arbitration agreement (Udechukwu, 2008). An arbit ration agreement can be included in the original or be in the form of a separate agreement, either at the time of the contract or subsequently.Therefore, even in the absence of an original integrated arbitration clause the parties can still decide to settle a presently existing dispute by arbitration. The arbitration agreement is the document, which is normally in writing containing details about the reference of the disputes for resolution by the arbitrators. It is an agreement on paper containing information signed by the parties; containing and providing records of the arbitration agreement (Oyegbile, 2000). It is a very important document guiding the entire process of arbitration.It also includes any reference in a contract to a document containing an arbitration clause which constitutes an arbitration agreement if such contract is in writing and the reference is such as to make that clause part of the contract. Unless a contrary intention is expressed in the arbitration agreeme nt, it shall be irrevocable except:- i. By agreement of the parties ii. By leave of the court or a Judge iii. Even, the occurrence of death of either of the parties does not automatically revoke the arbitration agreement.Rather, it shall be enforceable by or against the personal representatives of the deceased. In the past, arbitration agreement could be in oral but the present arbitration act only recognized written agreement to arbitrate. The implication of this is that only written agreements are enforceable by the courts or Judge. 1. 1AIM AND OBJECTIVES The aim of this work is to provide information on arbitration agreement under the Arbitration and Conciliation Act (ACA) CAP A18 2004.To achieve the above aim, the specific objectives are to: * Identify the categories of arbitration agreement * Examine the enforcement of the arbitration agreement * Identify parties to the arbitration agreements * Identify the major highlight of Arbitration and Conciliation Act (ACA). 2. 0LITERATU RE REVIEW 2. 1CATEGORIES OF ARBITRATION AGREEMENTS There are two basic types of agreement: [1] the arbitration clause and [2] the submission agreement.An arbitration clause looks to the future, whereas a submission agreement looks to the past. The first, which is most common, is usually contained in the principal agreement between the parties and is an agreement to submit future disputes to arbitration. The second is an agreement to submit existing disputes to arbitration. Arbitration clauses are usually short, whilst submission agreements are usually long. This is not because of any particular legal requirement. It is simply a reflection of the practicalities of the situation.An arbitration clause that deals with disputes which may arise in the future does not usually go into much detail, since it is not known what kind of disputes will arise and how they should best be handled. Indeed, although the parties to a contract may agree to an arbitration clause, they hope that there will be no need to invoke it. Usually they insert a short model clause, recommended by an arbitral institution, as a formality. By contrast, a submission agreement deals with a dispute that has in fact already arisen; and so it can be tailored to fit precisely the circumstances of the case.In addition to indicating the place of arbitration and the substantive law, it generally names the arbitrators, sets out the matters in dispute and even, if thought appropriate, provides for exchange of written submissions and other procedure matters. 2. 2ENFORCEMENT OF THE ARBITRATION AGREEMENTS Nigerian Courts have adopted a positive approach to the enforcement of arbitration agreements. A review of the decided cases shows a general recognition by Nigerian Courts of arbitration as a good and valid alternative dispute resolution mechanism. In C. N.ONUSELOGU ENT. LTD. V. AFRIBANK (NIG. ) LTD, the Court held that arbitral proceedings are a recognised means of resolving disputes and should not be taken lightly by both counsel and parties. However, there must be an agreement to arbitrate, which is a voluntary submission to arbitration. Where there is an arbitration clause in a contract that is the subject matter of Court proceedings and a party to the Court proceedings promptly raises the issue of an arbitration clause, the Courts will order a stay of proceedings and refer the parties to arbitration.SECTIONS 6(3) and 21 of the Lagos State Arbitration Law 2009, which â€Å"empowers the Court to grant interim orders or reliefs to preserve the res or rights of parties pending arbitration. † Although the ACA in section 13 gives the arbitral tribunal power to make interim orders of preservation before or during arbitral proceedings, it does not expressly confer the power of preservative orders on the Court and Section 34 of the ACA limits the Courts’ power of intervention in arbitration to the express provisions of the ACA.The usefulness of section 6(3) of the Lagos State Arbitration Law 2009 is seen when there is an urgent need for interim preservative orders and the arbitral tribunal is yet to be constituted. In this regard, such applications find no direct backing under the ACA and have always been brought under the Rules of Court and under the Court’s inherent jurisdiction to grant interim orders. However, in AFRIBANK NIGERIA PLC V HACO, the Court granted interim relief and directed the parties to arbitrate under the provisions of ACA.Upon the publication of the award the parties returned to the Court for its enforcement as judgment of the Court. The Courts in Nigeria are often inclined to uphold the provisions of Sections 4 and 5 of the ACA provided the necessary conditions are met. A live case in point is the case of MINAJ SYSTEMS LTD. V. GLOBAL PLUS COMMUNICATION SYSTEMS LTD. & 5 ORS, in this case, the Claimant instituted a Court action in breach of the arbitration agreement in the main contract and on the Defendant’s application , the Court granted an order staying proceedings in the interim for 30 days pending arbitration.In NIGER PROGRESS LTD. V. N. E. I. CORP. , the Supreme Court followed section 5 of the ACA which gives the Court the jurisdiction to stay proceedings where there is an arbitration agreement. In the owners of the MV LUPEX V. NIGERIAN OVERSEAS CHARTERING & SHIPPING LTD, the Supreme Court held that it was an abuse of the Court process for the respondent to institute a fresh suit in Nigeria against the appellant for the same dispute during the pendency of the arbitration proceedings in London. In AKPAJI V.UDEMBA, the Court held that where a defendant fails to raise the issue of an arbitration clause and rely on same at the early stage of the proceeding but takes positive steps in the action, he would be deemed to have waived his right under the arbitration clause. 2. 3THE PARTIES TO AN ARBITRATION AGREEMENT The parties to a contract must have legal capacity to enter into that contract, otherw ise it is invalid. The position is no different if the contract in question happens to be an arbitration agreement.The general rule is that any natural or legal person who has the capacity to enter into a valid contract has the capacity to enter into an arbitration agreement. Accordingly, the parties to such agreements include individuals, as well as partnerships, corporations, states and state agencies. If an arbitration agreement is entered into by a party who does not have the capacity to do so, (the law where applicable) may be invoked either at the beginning or at the end of the arbitral process. If it is invoked at the eginning of the process, the party requesting for it would ask the competent court to stop the arbitration, on the basis that the arbitration agreement is null and void. Where the validity of the arbitration agreement is raised at the end of the arbitration process, the requesting party would ask that the competent court to refuse the recognition and enforcement of such an award, on the grounds that one of the parties to the arbitration agreement is â€Å"under some incapacity† under the applicable law. 3. 0MAJOR HIGHLIGHTS OF THE ARBITRATION ACT a) The Arbitration Clause: The Arbitration and Conciliation Act (â€Å"ACA†) CAP.A18 2004 mandates that all arbitration agreements must be in writing and signed by the parties, in an exchange of letters, telex, telegram or other means of communication; or point of claim or defence. In Nigeria, arbitration clauses are irrevocable except by the leave of court or mutual agreement of parties. Even where parties had no prior agreement, with a submission agreement, parties may still submit to arbitration; b) Subject-matter Arbitrability: The â€Å"ACA† does not stipulate any particular subject matter that may not be referred to arbitration.The question of whether or not a dispute is arbitrable has therefore been left at the discretion of the Courts. In ARAB REPUBLIC V. OGUNWALE(2002 ) 9 NWLR (PART 771) 127,the Court of Appeal held that the test for determining whether a dispute is arbitrable or not is that the dispute or difference must necessarily arise from the clause contained in the agreement. However not all disputes are necessarily arbitrable c) Binding Nature: The â€Å"ACA5† provides that every arbitration award in Nigeria shall be binding on the parties.This is to preclude a recalcitrant party from preventing a successful party from enjoying the fruits of his judgment. d) Number of Arbitrators: In Nigeria, the number of arbitrators is either one or three. The parties to an arbitration agreement may determine their preferred numbers of arbitrators to be appointed under the agreement, but where no such determination is made, the number of arbitrators shall be deemed to be three. e) Challenge of an arbitrator: Parties may determine the procedure to be followed in challenging an arbitrator. Where no such procedure is determined a party who intends t o challenge an arbitrator shall, within ifteen days of becoming aware of the constitution of the arbitral Tribunal or becoming aware of any of the grounds, send to the arbitral Tribunal a written statement of the reasons for the challenge. f) Preservative Orders: The provisions of the ACA cloths the members of a Tribunal with the requisite powers to grant preservative orders during an arbitration reference. These orders however do not include granting injunctions etc. The Act provides that in such circumstance, the Tribunal can remit that portion of the reference to a proper court for the grant of such injunctive relief. ) Language to be used in Arbitral proceedings: In Nigeria, the parties may, by agreement determine the language or languages to be used in the arbitral proceedings. But where they do not do so, the arbitral Tribunal shall determine the language to be used bearing in mind the relevant circumstances of the case. h) Legal Representation: In Nigeria, the parties to an a rbitral proceeding may appear for themselves or be represented or assisted by a legal practitioner of their choice. i) The Award: An Award may be interim, interlocutory, or final. Any award made in Nigeria must adhere to the following: * It must be in writing; It must be signed by all the arbitrators (if they are more than one); * It must be delivered with a reason (except where parties agree otherwise); * The place where the Award was made must be stated on the award. j) The enforcement of an Award: An arbitral award shall, irrespective of the country in which it is made, be recognised as binding on the parties. This is made possible by the Foreign Judgments (Reciprocal Enforcements) Act, Cap 152, Laws of the Federation of Nigeria 2004, which makes foreign arbitral awards registerable in Nigerian Courts if at the date of registration it could be enforced by execution in Nigeria. . 1THE DOCTRINE â€Å"SEPARABILITY† It is also known as the doctrine or principle of autonomy or independence of the arbitration clause. Separability means the arbitrability clause in a contract is considered to be separate from the main contract of which it forms part and as such, survives the termination of that contract. It noteworthy to mention that arbitration agreement can be in form of an arbitration clause in a contract or in a separate agreement addressing disputes that have already arisen.The doctrine of separability is most relevant to arbitration clause in a contract an underlying contract. At the outset it must be recognised that this doctrine is inextricably linked with the doctrine of kompetence-kompetence which empowers the arbitrator to decide his own jurisdiction in the first instance. While kompetence-kompetence empowers the arbitration tribunal to decide on its own jurisdiction, the doctrine of separability affects the outcome of this decision.The doctrine of separability is provided for under Section 12(2) of ACA: For purposes of subsection (1) of this sect ion, an arbitration clause which forms part of a contract shall be treated as an agreement independent of the other terms of the contract and a decision by the arbitral tribunal that the contract is null and void shall not entail ipso jure the validity of the arbitration clause. For arbitral tribunals whose seat is in Nigeria (including under domestic arbitration) the source of this doctrine is article 12(2) of ACA quoted above which is a mandatory provision.Parties cannot therefore as a matter of contract, derogate from this provision and agree otherwise. Finally, separability thus ensures that if, for example one party claims that there has been a total breach of contract by the other, the contract is not destroyed for all purposes. Instead: â€Å"It survives for the purpose of measuring the claims arising out of the breach, and the arbitration clause survives for determining the mode of their settlement.
